Why Pure Play Matters

Do One Thing. Do It Right.

Appraisal Economics doesn’t file tax returns, audit, or prepare financial statements. We also don’t buy, sell, or broker anything. Valuation is all we do, so no other line of business can pull on our conclusions. For attorneys, CPAs, and finance leaders, that independence means a report you can put in front of an auditor, the IRS, or a court without having to explain away a conflict of interest.

Litigation Support

What Constitutes an “Expert Witness” in Court?

Anyone can testify to what they saw. Only a qualified expert may offer an opinion, and in federal court the judge decides whether that opinion is reliable enough for the jury to hear.

Fact witness

Testifies to what they personally saw, heard, or did. Generally may not offer opinions that call for specialized knowledge.

Expert witness

Qualified by knowledge, skill, experience, training, or education to give opinions that help the court understand the evidence or decide a disputed fact.

The judge as gatekeeper

Since Daubert v. Merrell Dow Pharmaceuticals (1993) and Kumho Tire Co. v. Carmichael (1999), federal judges screen all expert testimony, including financial and valuation opinions, for relevance and reliability before a jury hears it. Many state courts follow the same approach; others still apply the older Frye “general acceptance” test.

Federal Rule of Evidence 702

Under the rule as amended in December 2023, the party offering an expert must show the court it is more likely than not that:

  1. 01
The opinion will helpThe expert’s specialized knowledge will help the judge or jury understand the evidence or determine a fact in issue.
  2. 02
It rests on enough evidenceThe testimony is based on sufficient facts or data.
  3. 03
The method is reliableThe testimony is the product of reliable principles and methods.
  4. 04
The method was applied reliablyThe opinion reflects a reliable application of those principles and methods to the facts of the case.

A federal expert report must disclose

  • Every opinion and its basis
  • Facts or data considered
  • Supporting exhibits
  • Qualifications and publications from the past 10 years
  • Cases testified in during the past 4 years
  • Compensation for the work
